Acceptance of Terms and Conditions

These Terms and Conditions ("Terms") govern the User's access to and use of the website operated under the brand name "Comic Con India", along with any related mobile applications, software applications, and associated Services (collectively, the "Platform").

Please read these Terms carefully before accessing or using the Platform. By accessing, browsing, or using the Platform, the User acknowledges having read, understood, and agreed to be bound by these Terms, thereby entering into a legally binding agreement with Comic Con India. If the User does not agree to these Terms, or is unable to be legally bound by them, the User must not access or use the Platform or any Services offered thereon.

By accessing the Platform and/or availing any products or Services through it, the User agrees to be bound by these Terms, together with any additional terms, conditions, guidelines, or policies referenced herein or made available on the Platform from time to time. These Terms apply to all users of the Platform, including without limitation, browsers, customers, merchants, vendors, and contributors of content.

The User's access to and use of the Platform shall at all times be subject to these Terms and the Privacy Notice made available on the Platform (the " Privacy Notice"), which is incorporated herein by reference.

In the event of any conflict or inconsistency between these Terms and any other terms, conditions, or policies displayed on the Platform, these Terms shall prevail.

Applicability

Users who inquire about, access, or purchase any Services from Comic Con India through the Platform agree to be bound by these Terms and Conditions. The User and Comic Con India shall each be referred to individually as a "Party" and collectively as the "Parties" to these Terms.

Modification of Terms

Comic Con India reserves the right to modify or update these Terms at any time, at its sole discretion, without prior notice. It is the User's responsibility to review the Terms periodically. Continued access to or use of the Platform following any such modifications shall constitute acceptance of the revised Terms.

Privacy Notice

These Terms and Conditions, along with the 'Privacy Notice', which forms an integral part of the Terms, and any other applicable policies and/or notices published on the Platform, constitute a binding agreement between User and Comic Con India. The 'Terms and Conditions', 'Privacy Notice, and other applicable policies are electronic records under the Information Technology Act, 2000 (as amended) and relevant rules, including those pertaining to electronic records in applicable Indian laws.

Eligibility

1. In consideration of using the Platform, the User represents and confirms that they are of legal age to enter into a binding contract and are not a person prohibited from using the Platform or receiving the Services under the laws of India or any other applicable jurisdiction.
2. Registration on the Platform is optional. If the User registers, they will receive a user ID and password and are responsible for maintaining their confidentiality. The User is solely accountable for all activities conducted using their credentials and agrees not to use another party's ID or password without authorization. The User is responsible for securing their password and all transactions made through their account. The password is encrypted and stored securely, and Comic Con India does not have access to it. By using Comic Con India's Services, the User confirms they are the authorized holder of the account used. Comic Con India shall not be held liable for any loss or issues arising from misuse of account details.
3. The User agrees to: (a) provide true, accurate, and complete information during registration; and (b) promptly update the Registration Data to keep it accurate and current. If any information provided is false, inaccurate, outdated, or incomplete, or if Comic Con India suspects such, Comic Con India reserves the right to suspend or terminate the User's registration and refuse access to the Platform or any Services.

Content

1. All content provided through the Platform, including but not limited to audio, images, software, text, and icons ("Content"), is owned by Comic Con India and protected under applicable intellectual property laws. Users may only use this Content as specified herein.
2. In consideration of the User availing the Services on the Platform and submitting any content, and/or material ("User Content"), the User hereby irrevocably grants the Platform a perpetual, irrevocable, worldwide, non-exclusive, fully paid, royalty-free, assignable, sublicensable, and transferable licence and right to use such User Content and/or materials (including content shared by any business user having access to a "business page" to manage claimed business listings or otherwise) and all intellectual property rights therein, for any purpose whatsoever, including for API partnerships with third parties, and in any media now known or developed in the future. For the purposes of these Terms, "use" includes the right to use, copy, display, distribute, modify, adapt, translate, reformat, incorporate into advertisements or other works, analyse, promote, commercialise, create derivative works from, and otherwise exploit such User Content, and, in the case of third-party services, to permit their users and others to do the same. The User further grants Platform the right to use the name or username submitted in connection with the User Content. The User irrevocably waives, and undertakes to cause to be waived, any and all claims or assertions of moral rights or rights of attribution in respect of the User Content against Comic Con India, its customers, any third-party services, and their respective users.
3. The Platform displays various proprietary logos, service marks, and trademarks owned by Comic Con India and/or its affiliates, sister concerns, partners, vendors, and/or clients. No license, right, or authority to use these marks is granted to the User. Unauthorized use of the Content constitutes a violation of applicable law.
4. Comic Con India respects the intellectual property rights of others. If you notice any infringement on the Platform, please send a written notice that includes the following information:
   1. Clear identification of the copyrighted work you claim has been infringed;
   2. The location of the infringing material on the Platform, including the link to the material;
   3. Proof that the alleged copyrighted work is owned by you;
   4. Your contact information.
5. The aforesaid notices can be sent to Comic Con India by email at info@comicconindia.com with info@comicconindia.com to be marked in CC and post at Plot 119, Sector 31, Gurugram, Haryana – 122001.

Platform

1. The User agrees not to sell, trade, resell, or exploit any part of the Service for commercial purposes. For clarity, the Platform is intended solely for personal use and not for commercial exploitation. Additionally, the User agrees not to reverse engineer, modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works, transfer, or sell any information, software, products, or Services obtained from the Platform. Specifically, unauthorized, unlimited, or wholesale reproduction or copying of content for any purpose, whether commercial or non-commercial, as well as the unwarranted modification of any data or information on the Platform, is strictly prohibited.
2. As a condition of using the Platform, the User warrants that they will not use the Platform for any unlawful or illegal purpose under any applicable law, either within or outside India, or for any purpose prohibited by these Terms or any other policy or notice provided on the Platform. Additionally, the Platform shall not be used in any way that could damage, disable, overburden, or impair its functionality, or interfere with other users' ability to access and enjoy the Platform. The User agrees not to attempt to obtain materials or information through any means not intentionally made available or provided through the Platform.
3. Access to certain features of the Platform may be restricted to registered users. Registration may require the User to provide specific information, which may be personal in nature. Some fields may be mandatory, while others are optional. The User represents that all information provided to the Platform is true and accurate.
4. Comic Con India reserves the right, at its sole discretion, to terminate access to the Platform and its Services, in whole or in part, at any time, without notice, for maintenance or any other reason.
5. While Comic Con India strives to ensure its Platform is free of viruses or malware, any data downloaded or obtained through the Platform is at the User's own risk. The User is solely responsible for any damage to their computer systems or loss of data from downloading such content.
6. Comic Con India may periodically update or make changes to the Platform without prior notice. Users are encouraged to report any content deemed unlawful, offensive, defamatory, or in violation of applicable laws to Comic Con India. Upon receiving such reports, Comic Con India reserves the right to investigate and take appropriate action.

Liability

1. Comic Con India has made every effort to ensure that the information provided on the website and/or the Platform is accurate. However, Comic Con India does not warrant or make any representations regarding the quality, accuracy, or completeness of the data or information contained on the Platform. Comic Con India expressly disclaims all warranties, both express and implied, including but not limited to warranties of fitness for a particular purpose or merchantability with respect to the Platform and its contents. Comic Con India shall not be held liable for any loss, whether direct or consequential, incurred by any user or third party arising from the use of the information provided on the Platform.
2. Unless Comic Con India explicitly acts as a reseller in certain situations, it functions solely as a facilitator, connecting the User with relevant Service providers such as event organizers and other entertainment providers to enable you to book tickets for events, esports, and more, etc. (collectively referred to as "Providers"). Comic Con India's responsibility is limited to confirming the User's booking as selected.
3. Any issues or concerns that arise while availing Services from these providers are the sole responsibility of the Providers. Comic Con India disclaims any liability for the actions, omissions, errors, representations, warranties, breaches, or negligence of any Provider.
4. The User assumes all risks associated with the User Content, including any reliance by third parties on the quality, accuracy, or reliability thereof, and any disclosure by the User of information contained in such User Content that may render the User personally identifiable. While Platform reserves the right to remove User Content at its discretion, Platform does not control the actions of, or User Content posted by, its customers and does not warrant or guarantee the accuracy, integrity, or quality of any User Content. The User acknowledges and agrees that any User Content posted by customers, and any and all liability arising from such User Content, shall be the sole responsibility of the customer who posted such User Content, and not the Platform.
5. Unless explicitly stated as part of a product or Service offering, Comic Con India:
   • Assumes no liability for the quality or standard of Services provided by Providers.
   • Does not guarantee the quality or fitness of Services as represented by the Providers.
   • Does not guarantee the availability of Services listed by any Provider.
6. By purchasing any ticket, the User acknowledges that Comic Con India merely provides a technology platform for booking Services, and that the ultimate responsibility lies with the respective Provider. Therefore, the contractual relationship for the Service is between the User and the Provider.
7. The User also understands that the information displayed on the Platform regarding any Service is provided by the Provider. Comic Con India cannot be held liable for any inaccuracies, inadequacies, obsolescence, or violations of laws, rules, regulations, or directions regarding the information provided by the Provider.

Responsibility of the User

1. Service Description & Booking Confirmation: Users are advised to carefully review the Service descriptions before making a purchase. By confirming a purchase, the User agrees to be bound by all conditions outlined in the booking confirmation and the confirmed booking voucher.
2. Bookings on Behalf of Others:If a User is making a purchase on behalf of another person, it is the User's responsibility to inform that individual about the terms of this Agreement, including all applicable rules and restrictions.
3. Compliance with Guidelines and Laws: The User agrees to comply with all procedures, guidelines, and regulations, as amended from time to time, concerning the use of Services provided through Platform. Additionally, the User undertakes to abide by all applicable laws, orders, and directions issued by relevant authorities, including Central and State Governments, District Authorities, or any other statutory body, in relation to the use of Services or each transaction.
4. Service Availability and Disclaimers:Services are provided on an "as-is" and "as-available" basis. Comic Con India reserves the right to modify the features or functionality of the Services at its sole discretion, without prior notice. Comic Con India disclaims all warranties, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose. No advice or information, whether oral or written, obtained by the User from Comic Con India, Platform, or through the Services, shall create any warranty not expressly made in the Terms and Conditions.
5. Authorization for Communication: By using the Platform, the User authorizes Comic Con India representatives to contact them via phone, email, or message. This consent overrides any preferences set by the User in the National Customer Preference Register (NCPR) or similar preference settings.

Right to Refuse Service / Access to Account

1. Platform at its sole discretion reserves the right to not accept any request without assigning any reason thereof;
2. Without prejudice to other remedies available, Platform may limit the user's activity, remove the user's listing, warn other users, temporarily or permanently suspend or terminate the user's registration, and/or deny access to the website/Platform if: (a) the User is in breach of the Terms and Conditions, (b) Platform is unable to verify or authenticate any information provided by the User, or (c) Platform believes that the User's actions may infringe on any third-party rights or breach any applicable laws and/or regulations or otherwise result in any liability for the User, other users of the Platform and/or Comic Con India;
3. Platform will not provide any Service or share confirmed transaction details till such time the complete consideration is received from the User;
4. Any default or inaccuracy in any information and/or representations may disqualify the User from availing Services;
5. If Comic Con India discovers or suspects that a Service request is unauthorized or contains incorrect information, or if any facts are misrepresented, Comic Con India reserves the right to take legal action, including cancelling the purchases without prior notice. Comic Con India will not be liable for any loss or damage resulting from such cancellations;
6. In case of judicial, quasi-judicial, or government authority intervention, Platform may cancel purchases without notifying the User. The User agrees not to hold Comic Con India and/or the Platform responsible for any losses due to measures taken to protect its interests or prevent fraud, including the denial or cancellation of purchases based on suspected fraud;
7. If the User breaches any of the terms mentioned herein and/or any other policy or notice published and/or uploaded on this Platform, Platform reserves the right to, without limitation, suspend the User account, cancel any service, and/or take appropriate legal action as it deems necessary;
8. User shall not send any content and/or communication to Comic Con India in a language and/or through any mode or medium, which is: (a) abusive, threatening, offensive, defamatory, coercive, obscene, belligerent, glorifying violence, vulgar, sexually explicit, pornographic, illicit or otherwise objectionable; (b) contrary to applicable law; (c) violates third parties' rights; (d) a spam; or (e) in breach of any other part of these Terms and Conditions;
9. If the User violates any of the aforesaid terms, Comic Con India shall be at liberty to take appropriate legal action against the User.

Right to Cancel

1. The User agrees to provide accurate and valid information when using the Platform under this Terms and Conditions and warrants not to make any misrepresentation of facts. Any failure to comply with this obligation will disqualify the User from availing the Platform Services.
2. If Comic Con India discovers or reasonably believes that a service request is unauthorized, contains incorrect information, or involves any misrepresentation by the User, Comic Con India may take legal action, including cancellation of purchases without prior notice. In such cases, Comic Con India will not be liable for any loss or damage resulting from the cancellation.
3. If required by judicial, quasi-judicial, or government authorities to cancel a booking, Platform will do so without notifying the User.
4. The User shall not hold Comic Con India and/or Platform liable for any loss or damage arising from actions taken to protect Comic Con India's interests or those of its legitimate customers, including but not limited to cancellation of purchases in cases of suspected fraud.

Force Majeure

1. Comic Con India and/or Providers may be unable to honour confirmed tickets due to exceptional circumstances, including but not limited to acts of God, including fire, flood, earthquake, storm, hurricane or other natural disasters, labour unrest, insolvency, government action or inaction, war, civil unrest, invasion, an act of foreign enemies, hostilities (regardless of whether war is declared), civil war, strikes, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalization, government sanction, pandemic, epidemic, or lockdowns imposed by any authority, blockage, embargo, operational or technical issues, or other events beyond Comic Con India's and/or Provider's control. In such cases, Comic Con India and/or Provider, as the case may be, will endeavour to offer alternatives or, if applicable, refund the booking amount (less service charges) as refunded by the respective Providers. Comic Con India, acting solely as an intermediary, is not liable for any Force Majeure events.
2. In the event of non-confirmation due to technical failures, Comic Con India's liability shall be limited to refunding any amounts paid by the User (less any service charge). This refund will discharge Comic Con India from any further obligation or liability concerning that transaction, with any additional liabilities to be borne by the User.
3. Under no circumstances shall Comic Con India be liable for any direct, indirect, punitive, incidental, special, or consequential damages, including but not limited to loss of use, data, or profits, arising from the use or performance of the Platform.

Proprietary Rights

1. Platform may offer the User content such as audio, images, graphics, videos, or other materials featured in ads or information, which could be protected by copyright, trademark, or other intellectual property laws. The User is permitted to use this content only as specifically authorized by Platform and is prohibited from copying, distributing, or creating derivative works from it without Platform's explicit permission.
2. The provision of copyrighted materials hereto shall not be construed as a license, transfer, assignment, grant, or any other form of right, title, or interest in or to such content. All rights, title, and interest in and to the content shall remain solely with the respective right holder at all times.
3. The User acknowledges and agrees not to upload, post, reproduce, or distribute any content on the Platform that is protected by copyright or other proprietary rights of a third party without obtaining the necessary permission from the rights holder. Any content shared on the Platform with the owner's consent must include the appropriate copyright or proprietary rights notice. Unauthorized submission or distribution of such content is illegal and may result in personal liability or criminal prosecution.

Relationship

Nothing in this Terms and Conditions, policies and/or notices, and/or the User's right to use the Platform shall be construed to create a partnership between the User and Comic Con India. Neither party shall have the authority to bind or act as the agent of the other in any manner. However, by using the Platform, if the User authorizes Comic Con India and its agents to access third-party sites on their behalf to retrieve requested information, Comic Con India and/or its agents shall bear no liability and/or responsibility arising therefrom whatsoever.

Indemnity

The User agrees to indemnify, defend, and hold harmless Comic Con India from any and all losses, liabilities, claims, damages, costs, and expenses (including legal fees, disbursements, and any interest incurred) arising from or related to any breach any representation, warranty, covenant, agreement, or obligation by the User under this Terms and Conditions and/or any notices, policies uploaded, published on the Platform and/or otherwise communicated to the User.

User Beware

1. Comic Con India's employees or authorized representatives will never ask a User for sensitive information such as credit/debit card numbers, expiration dates, CVV, net banking logins, passwords, OTPs, or request a fund transfer to a personal bank account.
2. They will also never instruct a User to install third-party applications to access their mobile or computer screens.
3. Responding to such requests may expose you to fraud, potentially leading to financial loss or compromise of personal information. If you are ever asked for such information, please immediately report it to info@comicconindia.com.

Communication

1. Platform will send relevant transactional information to the User, such as purchase confirmations, details, cancellations, payment confirmations, refund status, schedule changes, and any other information related to the booking and/or promotional and marketing information, through SMS, internet-based messaging platforms (like WhatsApp), voice calls, email, or any other communication method provided by the User during the booking process.
2. Platform may also contact the User via the aforementioned communication methods for pending or failed bookings, to ascertain the User's preferences and assist in completing the booking.
3. The User unconditionally consents to such communications being:
   • Initiated at the User's request and authorization,
   • Categorized in accordance with the Telecom Regulatory Authority of India (TRAI) guidelines, and
   • In compliance with relevant TRAI regulations or other applicable authorities in India and internationally.
4. The User agrees to indemnify Comic Con India against any losses or damages incurred due to actions taken by TRAI, Access Providers, or any other authority arising from erroneous complaints filed by the User or from providing incorrect contact details (phone number or email).

Miscellaneous

1. SEVERABILITY: If any provision of this Terms and Conditions is found to be invalid or unenforceable, it will apply only to that provision, and the remainder of the Terms and Conditions will remain in full effect.
2. JURISDICTION: These Terms and Conditions shall be governed by the laws of India. Any unresolved disputes will be subject to the exclusive jurisdiction of courts in Gurugram, Haryana.
3. CONFIDENTIALITY: Any information designated as confidential by Comic Con India must be kept confidential by the User and disclosed only as required by law or for the purposes of these Terms and Conditions.
4. FEEDBACK: Comic Con India may contact Users for feedback to improve its Services via email, call, SMS, or other means. If the User prefers not to be contacted, they may opt out by writing to info@comicconindia.com.
5. NOTICE: All notices and communications (including those regarding changes to the Terms and Conditions, Notices, Policies, etc.) must be in writing and in English. Such notices will be deemed to be given if delivered personally, via commercial messenger or courier, mailed by registered or certified mail (with return receipt requested), or sent via email/facsimile (with acknowledgment of complete transmission) to the following address: Plot 119, Sector 31, Gurugram, Haryana – 122001.
6. PRIVACY POLICY:By using the Platform, the User agrees to Platform's Privacy Policy, which governs the use of personal information.
7. GRIEVANCE REDRESSAL: If a User is dissatisfied with the resolution of their issue, they may contact the grievance officer. The officer will aim to address concerns within 30 working days. Users must first raise a complaint and provide the booking reference number and ticket ID for escalation. The contact details of the Grievance Officer are provided below:
